I am renting at a place. The landlord knows that people are doing drugs in the house, and that it is causing breathing problems because of the smoke from the drugs with a couple of the tenants, including myself.

The neighbors have complained, and have pictures as proof.

The worst part is, she is not ignoring it. She knows, she just tells them "not to do it again". And so they say, "okay, I will not", but are just lying because they know she is so stupid she will believe them every single time. She says "forgive them". Then she told me, they have one more chance. Then she will evict them. (This is the eighth time she has said this). This time she sounded serious. So I say okay. That night he of course continues smoking in the house. (note: also the other problem is he has three of his drugee friends over, they come over at 1am every night and start banging, laughing really loud, playing loud music, and doing drugs. She knows this too.) She told me to call her the next morning if they continued, and that she would file eviction papers this time.

So the next morning, I called her and told her nothing changed as usual. She said "you need to forgive them". Now I am like, WHAT THE FU*K!!!!!

Now I do not even feel like paying rent, because it is making my life miserable and I cannot bring over clients (I work from home as a web designer) to the house, because of course there is drugs and I would probably lose the client. So I am getting less business, it is also hurting my income.

Can I sue her for damages for refusing to evict the tenant?

It was same problem with two other tenants, but they moved out after not paying rent for two months. They did it just to take advantage of her. I am not trying to take advantage of her, I am only trying to live my life. I really like this room. I do not want to move. But I have to now because I cannot be in a house with smoke! This is going to cause more problems, because my business is registered at this address.

Also, no one is on a lease. She refuses to even make a lease. I went out and bought a printer, paper, and printer ink and offered to make a lease for her that would forbid tenants from smoking or doing drugs in the house or making loud noise at night, so that they can easily be evicted via the lease and removed by the police if they refuse to leave. First she told me okay, so I bought the items. Then she told me, no, she does not want to make a lease! Well I am kind of okay because I did need a printer and paper, so I will actually use these things, but the point is that she is making my life hell from her apathy, neglect, and complete stupidity!

The next time they're doing drugs, call the police.

You can sue the landlord for not taking any action. Thereby, your landlord is actually supporting such activites.

Next, lodge a police report whether it's now or then. You can make a complain cause in anyway, whether they are there or not, they would still have to do inspection.

Are you saying you've been there 2 years or was that somewhere else,either way just move the hell out.What are you waiting for.

Am pretty sure you can . This fall in your right torenta safe , heatlhy environment ( if the smoke is causing you breathing problems)even the nosie can cause you to take the landlord to court . If I were you I would check & look upmy local tenant policy guide .
